Terms of Service

These Terms of Service (Terms) are a legally binding agreement between you and BeeServer Osauhing, Ranniku tee 20, Tallinn, Harjumaa 12112, Estonia (BeeServer, we, us, or our). They govern your use of the PinPosto mobile application, website, and related services (together, the Service).

By continuing into or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use PinPosto

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf. You may use the Service only in compliance with applicable law. The Service is intended for personal, non-commercial use unless we agree otherwise in writing.

2. Your account

PinPosto creates an anonymous guest account for you. You are responsible for activity performed through that account and for keeping your device secure. Do not impersonate another person, misrepresent your identity, evade a suspension, or transfer your account to someone else.

Your account may depend on access to the device or app installation on which it was created. You may lose access if you delete the app, clear its data, lose the device, or otherwise lose its locally stored credentials.

3. The Service

PinPosto lets people discover and participate in public conversations attached to geographic locations. Each PinChat and its messages may be visible to nearby users and to people responsible for operating or moderating the Service. PinChats may expire automatically according to the lifetime shown in the app.

PinPosto is not an emergency, navigation, law-enforcement, or personal safety service. Do not rely on it to request urgent help or to make decisions affecting anyone's health or safety.

4. Location and physical safety

You can browse the map, open PinChats, and read or send messages without granting location permission. Location access is optional during guest entry and PinChat creation and is used to choose a convenient initial map position. You may place a PinChat anywhere on the map. A PinChat's location is public, and posting at or interacting with a location may allow others to infer where you are or have been. Think carefully before sharing content that identifies your home, workplace, routine, or another person's location.

Do not use PinPosto while driving or in any situation where it may distract you or create a risk. Do not trespass, enter unsafe places, or attempt to meet another user without taking appropriate safety precautions.

5. Your content

You retain ownership of content you submit, including display names, PinChat titles, message text, and attached photos (Your Content). You are responsible for Your Content and must have the rights and permissions needed to submit it.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, adapt, and otherwise use Your Content only as needed to operate, secure, improve, and promote the Service. This license ends when Your Content is deleted from our systems, except where continued retention is required by law or reasonably necessary for security, moderation, backups, or dispute resolution.

Because PinChats are public, other users may see, quote, capture, or share Your Content. Do not submit anything you expect to remain private or confidential.

6. Acceptable use

You must not use the Service to:

  • post unlawful, threatening, harassing, hateful, sexually exploitative, deceptive, defamatory, or privacy-invasive content;
  • reveal another person's sensitive information or precise location without permission;
  • infringe intellectual-property, privacy, publicity, or other rights;
  • promote violence, self-harm, dangerous activity, fraud, spam, or illegal goods or services;
  • interfere with the Service, bypass security controls, scrape data, reverse engineer protected components, or use bots or automated access without our written permission; or
  • encourage, assist, or attempt any of the conduct described above.

7. Reporting and moderation

You can report a PinChat or an individual message through the app. We may review reports and investigate suspected violations. We may hide, permanently remove, restore, or restrict content; limit features; or suspend or terminate accounts when reasonably necessary to enforce these Terms, comply with law, protect people, or protect the Service.

We are not obligated to pre-screen all content and cannot guarantee that every violation will be identified immediately. Moderation decisions may consider context, severity, frequency, risk, and legal requirements.

An author may soft-delete their own message within 10 minutes after posting it. Administrators may soft-delete messages as part of moderation. Other users then see a deleted-message placeholder, but the original text, attached photo, deletion time, and related moderation information may remain available to authorized administrators for moderation, abuse prevention, audit, restoration, or dispute resolution. Administrators may also permanently delete an entire PinChat and its associated messages, photos, reports, and restoration backups when reasonably necessary.

8. Child safety standards

PinPosto has zero tolerance for child sexual abuse and exploitation (CSAE). You must not use the Service to create, upload, distribute, solicit, or facilitate child sexual abuse material (CSAM), child grooming, sextortion, the sexualization or sexual exploitation of a minor, child trafficking, or any other conduct that sexually abuses, exploits, or endangers children.

Users can report a PinChat or an individual message in the app and may also submit concerns through the in-app feedback feature. We review reported content and, when we obtain actual knowledge of prohibited content or conduct, take appropriate action in accordance with these Terms and applicable law. This may include hiding or permanently removing content, restricting or terminating accounts, preserving relevant information when legally required, and cooperating with law enforcement.

We report confirmed CSAM to the National Center for Missing & Exploited Children (NCMEC) or the appropriate regional authority when required by applicable law. Child-safety concerns and notices may be sent to BeeServer's child-safety contact at apps@beeserver.ee. If a child is in immediate danger, contact local emergency services or law enforcement first.

9. Our rights and intellectual property

The Service, including its software, design, branding, and content we provide, is owned by us or our licensors and is protected by intellectual-property law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

These Terms do not give you ownership of the Service or permission to use the PinPosto name, logo, or branding. Feedback you voluntarily provide may be used by us without restriction or compensation.

10. Third-party services

PinPosto relies on third-party services, including Google Maps and Firebase. Your use of third-party features may also be governed by their terms and privacy policies. We are not responsible for third-party services or for changes, interruptions, or content they control.

11. Account deletion and termination

You may stop using PinPosto at any time and may request account deletion using the in-app controls or our account deletion instructions. Deletion and retention are further described in our Privacy Policy.

We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if operating the Service is no longer commercially or technically practical. Where appropriate, we will try to provide notice, but immediate action may be required for safety, security, or legal reasons.

12. Changes to the Service or these Terms

We may add, change, suspend, or discontinue features. We may also update these Terms as the Service or applicable law changes. We will post the revised Terms and update the date above. When required, we will provide additional notice or ask you to accept the revised Terms. If you do not agree to an update, you must stop using the Service.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted, secure, accurate, or error-free operation.

We do not control or endorse user content. To the maximum extent permitted by law, BeeServer is not responsible for user-submitted PinChat titles, messages, attached photos, or other user content, or for loss or harm arising from viewing, relying on, or interacting with that content. We are also not responsible for another user's conduct. You may encounter content or people you find offensive, inaccurate, misleading, unlawful, or unsafe. Nothing in these Terms excludes warranties, liability, or rights that cannot legally be excluded, including mandatory consumer rights.

14. Limitation of liability

To the maximum extent permitted by law, BeeServer and its directors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, use, or opportunity, arising from the Service or these Terms.

Nothing in these Terms limits liability where doing so is prohibited by law, including liability for intentional misconduct or any mandatory rights available to consumers.

15. Your responsibility

To the extent permitted by law, you are responsible for losses, claims, and reasonable costs arising from Your Content, your unlawful use of the Service, or your material breach of these Terms. This does not require a consumer to compensate us beyond what applicable law permits.

16. Governing law and disputes

Please contact us first so we can try to resolve any concern. These Terms are governed by Estonian law, without limiting any mandatory protections provided by the law of your country of residence. Courts in Estonia will have jurisdiction unless applicable consumer law allows or requires you to bring a claim elsewhere. If you are an EU consumer, you may also bring proceedings in the courts where you live where applicable law permits.

17. General terms

These Terms and the documents they incorporate are the entire agreement between you and us about the Service. If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours as part of a reorganization, merger, acquisition, or sale of assets, subject to applicable law.

Provisions that by their nature should survive termination—including provisions about ownership, responsibility, disclaimers, liability, and disputes—will survive.
